CfR Notice to MIT Members:
Questionnaire - CRS & FACTA in practice

The Commissioner for Revenue has notified that it has launched a fact-finding questionnaire to better understand how the Common Reporting Standard (‘CRS’) and the Foreign Account Tax Compliance Act (‘FATCA’) are being implemented in practice. The aim of this questionnaire is to assist the Commissioner in identifying practical difficulties faced by Financial Institutions (FIs) for the Commissioner to be able to provide the necessary support to FIs to address these issues. The Questionnaire is split into three sections:

  1. Due diligence procedures
  2. Reporting
  3. Application of the CRS / FATCA in practice

The questionnaire will take approximately 1 hour to complete and participation is on a no-names basis. The questionnaire will be available for four weeks and is available here.

The industry encouraged to submit sector specific issues relating to the practical implementation of the CRS / FATCA to the Office of the Commissioner for Revenue at aeoi-admin.cfr@gov.mt. This will help the Commissioner in reaching out to the sector to discuss and assist accordingly including through sector-specific guidelines.

We encourage MIT Members who may possess any relevant information on sector specific issues relating to the practical implementation of the CRS / FATCA to participate in this initiative and submit feedback.
